1. Service Description
4Marketers offers human-led positioning and analysis services for businesses (the "User"). Each service allows the User to submit links to their own and external product pages. Senior consultants review and sign off on every deliverable, supported by proprietary AI that conducts the analysis at speed and depth.
The analysis output is intended to support business decision-making. As with all advisory work, outputs provide strategic insights and do not guarantee factual accuracy or completeness. The User remains responsible for verifying all information before relying on it.
These Terms apply exclusively to business customers (B2B). By purchasing or using 4Marketers' services, the User confirms that it is acting in the course of its business, trade, or profession, and not as a consumer.
2. User Responsibility
The User is solely responsible for submitting links only to content that is publicly accessible on the internet and that does not require bypassing technical protections (e.g., login, CAPTCHA, or similar). The User guarantees that the submitted links do not infringe upon third-party rights or violate applicable laws. The User is responsible for ensuring that the use of the linked information complies with the terms and conditions of the respective website.
3. Our Responsibility
4Marketers retrieves only publicly accessible data from the links provided by the User — only public information retrieved from official websites. The service does not reproduce original content in its entirety (e.g., full texts or images) but instead delivers processed outputs in the form of summaries, comparisons, and insights. 4Marketers is not responsible for the accuracy, completeness, or availability of information obtained from external websites.
4. Service Delivery
4.1 Delivery Timeline
4Marketers will use reasonable efforts to deliver the agreed analysis output within the timeframe specified at the point of purchase or in the relevant order confirmation. If no specific timeline is stated, delivery will occur within ten (10) business days of receipt of all required inputs from the User.
4.2 Delivery Method
Deliverables will be provided digitally, in the format specified at the time of purchase. Delivery is deemed complete upon transmission to the User's designated contact or email address.
4.3 User Inputs
Timely delivery is contingent on the User providing all required links, information, and access in a timely manner. 4Marketers shall not be liable for delays caused by the User's failure to provide required inputs.
4.4 Revision and Disputes
If the User believes a deliverable materially fails to meet the service description, the User must notify 4Marketers in writing within ten (10) business days of delivery. 4Marketers will review the concern and, at its discretion, provide a revised output or a credit toward future services. No refund or revision will be available after this period or where the User's dissatisfaction relates to strategic disagreement rather than a material deficiency in the service as described.
5. Intellectual Property Rights
The analysis delivered by the service is a processed output and is licensed to the User for internal business use only. Copyright and other rights to original content (e.g., product images, texts) remain with their respective rights holders and are not transferred through this service.
6. Restrictions on Use
The User may not resell, redistribute, or otherwise commercially exploit the analysis output outside their own organization. The User may not use, copy, or otherwise exploit the analysis output for the purpose of developing, training, or improving machine learning models, AI systems, or similar technologies. Any such unauthorized use will constitute a breach of these Terms and may result in termination of access and/or legal action.
7. Limitation of Liability
7.1 Exclusion of Indirect Damages
4Marketers is not liable for indirect damages, loss of profits, loss of revenue, loss of business, loss of anticipated savings, or consequential damages of any kind arising from the use of the service.
7.2 Liability Cap
To the maximum extent permitted by applicable law, 4Marketers' total aggregate liability to the User under or in connection with these Terms — whether in contract, tort (including negligence), breach of statutory duty, or otherwise — shall not exceed the total fees paid by the User for the specific service giving rise to the claim in the twelve (12) months preceding the event giving rise to the claim.
7.3 Basis of the Bargain
The User acknowledges that the limitations of liability in this Section 7 reflect a reasonable allocation of risk and form an essential basis of the bargain between the parties. 4Marketers would not be able to offer its services at the current pricing without these limitations.
8. Confidentiality
Each party agrees to keep confidential any non-public information disclosed by the other party in connection with the services, and to use such information only for the purposes of these Terms. This obligation does not apply to information that is publicly available, already known to the receiving party, or required to be disclosed by law. This obligation survives termination of the commercial relationship for a period of three (3) years.
9. Term and Termination
These Terms apply from the moment the User purchases or accesses 4Marketers' services and continue until the relevant service is delivered and all obligations are fulfilled. Either party may terminate ongoing service arrangements with thirty (30) days' written notice. 4Marketers may suspend or terminate access immediately in the event of material breach of these Terms, including but not limited to unauthorized use of outputs, non-payment, or violation of Section 6.
10. Governing Law and Dispute Resolution
10.1 Governing Law
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions.
10.2 Dispute Resolution
Any dispute, controversy, or claim arising out of or in connection with these Terms, or the breach, termination, or invalidity thereof, shall be finally settled by arbitration administered by the Stockholm Chamber of Commerce (SCC) in accordance with the SCC Rules for Expedited Arbitrations. The seat of arbitration shall be Stockholm, Sweden. The language of the arbitration shall be English. The arbitral tribunal shall consist of one (1) arbitrator. The parties agree that arbitration proceedings and any awards shall be kept confidential.
10.3 Urgent Relief
Nothing in this Section 10 shall prevent either party from seeking urgent interim or injunctive relief from a competent court where necessary to prevent irreparable harm.
11. Changes to These Terms
4Marketers reserves the right to update or amend these Terms at any time. For existing customers with active service arrangements, changes will be communicated with at least thirty (30) days' written notice and will not apply to services already purchased prior to the effective date of the change. The latest version will always be available on our website. Continued use of our services after the effective date of any changes constitutes acceptance of the updated Terms.
12. General Provisions
12.1 Entire Agreement
These Terms constitute the entire agreement between 4Marketers and the User with respect to the subject matter hereof, and supersede all prior agreements, representations, and understandings.
12.2 Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
12.3 No Waiver
Failure by either party to enforce any provision of these Terms shall not constitute a waiver of that party's right to enforce such provision at a later time.
12.4 Assignment
The User may not assign or transfer any rights or obligations under these Terms without the prior written consent of 4Marketers. 4Marketers may assign its rights and obligations with reasonable notice to the User.
